Strauss Troy acts as co-counsel for COVID-19 business interruption insurance claims

The law firms have reviewed a large number of so-called “all risk” business insurance policies. Most of those policies have more coverages excluded than risks covered. While some policies do have “virus exclusions,” those exclusions may not be applicable to a claim for loss of business income. The law firms recently filed two cases against insurance companies in an effort to recover for businesses that were shut down pursuant to orders of governmental authorities. One of the cases was filed in Hamilton County, Ohio, on behalf of a Mason, Ohio preschool. The other was filed in McCracken County, Kentucky, on behalf of a Paducah restaurant. The law firms are now in the process of reviewing a large number of additional policies for other businesses.
